a) General Information

Spacewell Spain, S.L. (hereinafter “Spacewell Spain“) is the owner of the Web Site https://www.dexma.com/es/ (hereinafter the “Web Site“) and the application app.dexma.com (hereinafter the “Application”), both jointly referred to as “Web Products” and is the Data Controller of the personal data of the users of these (hereinafter the “Users“). 

Through this Privacy Policy, and in compliance with Articles 12 and 13 of Regulation (EU) 2016/679 (hereinafter “GDPR“) and Article 11 of Organic Law 3/2018, of December 5, on the Protection of Personal Data and guarantee of digital rights (“LOPDPGDD“), Spacewell Spain informs Users who use the Web Products about the processing of their personal data that may be collected through this and processed by Spacewell Spain.

2. SECURITY AND CONFIDENTIALITY 

Spacewell Spain undertakes to adopt the necessary physical, technical and organizational measures, in accordance with the provisions of the applicable regulations, to ensure the security of personal data and prevent the accidental or unlawful destruction, loss or alteration of personal data transmitted, stored or otherwise processed, or unauthorized communication or access to such data. Personal data will be treated confidentially by Spacewell Spain, which undertakes to inform and enforce, by legal or contractual obligation, such confidentiality to its employees, partners and any person who should have access to the User’s personal data.  

3. INTERNATIONAL DATA TRANSFERS (EXTERNAL SERVICE PROVIDERS)

Spacewell Spain is based in Spain. We use third party technology services for the provision of Services, who may process your data in the course of providing their services to us. Some of these providers may be located outside the European Economic Area, in countries that may not generally provide adequate safeguards for the protection of personal data, however, Spacewell Spain has entered into agreements with such providers with the necessary contractual safeguards under the law. You may contact us to consult or obtain copies of such agreements.

4. USERS’ RIGHTS

The User may exercise the rights of access, rectification, deletion, opposition and, where appropriate, limitation of processing and portability of data by sending an email to legal.energy@spacewell.com. 

Likewise, the User may file a complaint with a supervisory authority and, in particular, with the Spanish Data Protection Agency (www.aepd.es) if he/she considers that the rights set forth above in this Privacy Policy have been violated or if he/she considers that the processing of personal data concerning him/her violates the applicable regulations.

5. CHANGES IN THE PRIVACY POLICY

Spacewell Spain reserves the right to modify this Privacy Policy at any time. Changes or updates to the Privacy Policy will be explicitly notified to the User by means of a notice on the Web Products, together with the updated version of the Privacy Policy.

Consent and legitimate interest	Attend and respond to requests, comments, suggestions. As well as to provide support to the User during the use of the Web Products.	Personal data will be processed by Spacewell Spain for the time necessary to answer the question and/or resolve the incident indicated by the User. Said data will be blocked in order to comply with Spacewell Spain’s legal obligations and, once this period has elapsed, will be definitively deleted.
Commercial communications. If you check the corresponding box, you agree to receive commercial communications from us regarding our services. For this purpose, the User’s e-mail address will be processed.	Consent of the interested party.	If you have consented to receive commercial communications, this data is used to send you commercial information about Spacewell Spain. For more information about commercial communications, please see our Legal Notice .	The data will be processed by Spacewell Spain until the User withdraws his/her consent. Once consent has been withdrawn, Spacewell Spain will block your data for the time necessary to comply with legal obligations. At the end of this period, the data will be definitively deleted.

 

c) Application Information

User Registration Data. first name, last name, company, telephone, and email address. These data are mandatory and if they are not provided, an account cannot be created.	Execution of the contractual relationship to which the interested party is a party.	Creation of an account to the User: These data will be processed in order to create a user account and can use the services we provide.	Personal data will be treated by Spacewell Spain during the contractual relationship between Spacewell Spain and the User. Said data will be blocked in order to comply with Spacewell Spain’s legal obligations and, once this period has elapsed, will be definitively deleted.

 

USERS ACCESSING THE APPLICATION THROUGH A SPACEWELL SPAIN PARTNER COMPANY

In the event that the User accesses the Application as a customer of a company that is a partner of Spacewell Spain (“Partner”), i.e. the User is not an end customer who has contracted directly with Spacewell Spain (hereinafter, the Partner’s customer), Spacewell Spain will process the User’s personal data as Data Processor, and not as Data Controller, on behalf of and under the instructions of the Partner, of which it is a service provider and with which it has signed the corresponding personal data processor agreement. The Partner’s privacy policy shall prevail over this Privacy Policy. 

In these cases, the Data Controller is the Partner company with whom the Partner User has signed an agreement to access the Application and is the one to whom the Partner User must exercise his or her rights, being able to contact, in a subsidiary manner, Spacewell Spain according to the provisions of section 4 of this policy.

 

USERS ACCESSING THE APPLICATION ON BEHALF OF A SPACEWELL SPAIN CLIENT COMPANY

In the event that the User accesses the Application as a worker, employee, collaborator, or any other analogous labor or commercial relationship, of a company that is a client of Spacewell Spain (“Client Company”), Spacewell Spain will process the User’s personal data as Data Processor, and not as Data Controller, on behalf of and under the instructions of the Client Company, as service provider, and with whom it has signed the corresponding personal data processor agreement. The privacy policy of the Client Company shall prevail over this Privacy Policy. 

In these cases, the Data Controller is the Client Company with whom the User has the aforementioned employment or commercial relationship and it is before whom the User must exercise his/her rights, being able to address, in a subsidiary manner, to Spacewell Spain according to the provisions of section 4 of this policy.
