Spacewell Energy (Dexma) is committed to protecting the privacy of all users of our website and Services (“You/r”).  At www.dexma.com and https://app.dexma.com we offer software solutions for the energy management of industrial and commercial buildings.

On that website, Spacewell Energy (Dexma) collects and treats 3 types of data, (1) navigation data (2) data provided by users by completing the web forms and (3) registration data. This data will be used by us to provide the service that Spacewell Energy (Dexma) offers, as well as for the other purposes established below.

We maintain the security and confidentiality of your data in accordance with the applicable law and we do not disclose your personal data to third parties except as indicated. Spacewell Energy (Dexma) is a subsidiary of Spacewell International NV, with a registered office at Sneeuwbeslaan 20 bus 3, 2610 Wilrijk, Belgium, and we may share your commercial contact data with them as indicated below.

By completing and submitting your personal data to Spacewell Energy (Dexma), through any online registration or other forms submitted to our services, you declare to have read and accepted the terms of this Policy. If you have consented to the receipt of commercial communications, you can revoke the consent at any time by writing to legal@dexma.com attaching a copy of your identity document.

The entity responsible for your registration data is DEXMA Sensors, S.L. (“Spacewell Energy (Dexma)” or “DEXMA” or “we/us”), located at Carrer Nàpols, 189, 08013, Barcelona and with CIF B64461270. All communications regarding the processing of your personal data shall be directed to our Data Protection Responsible indicated below.

  1. PERSONAL INFORMATION WE COLLECT ABOUT YOU AND HOW WE USE IT
  • Data collected

We collect and process the following data of our platform users:

a) Navigation. Due to the standards of communications on the Internet, when you visit our website we automatically receive the URL of the site from which you come and the site you visit when you leave our website. We also receive the internet protocol (“IP”) address of your computer and the type of browser you are using. We use this information to analyse global trends to improve the service. This information is not shared with third parties without your consent. Except for the above, and what is stated in our cookies policy, we do not collect any type of personal data if you are only browsing the website.

 b) Web Forms. If you complete any web form (Contacts, Jobs, Partners, Comments, Demo Service, Content, Webinar, Event), we collect the personal data that you indicated in the forms and You have sent us, including your name and email address. The fields of the form that must be filled in are indicated as obligatory. These personal data are used to process your request and contact you for additional communication.

c) Registration (demo or complete client). When registering for our services, we will collect your following personal data: name, surnames, company, telephone and email address. These data are required and if they are not provided, we cannot create your account. You are responsible for the accuracy of the information you provide, and Spacewell Energy (Dexma) reserves the right to exclude from the services any user who has provided false or inaccurate information, without prejudice to other available resources.

Prohibited data. In all events, it is forbidden to submit to us or upload to the Services any data that contains sensitive personal data that is relative to identifiable persons such as: your and or third party’s racial origin, membership in a trade union, religion, ideology and sexual life, your and or third party’s health; or your and or third party’s relative to the commission of criminal offences or proceedings and associated penalties or fines.

It is important that the personal data we hold about you is accurate and current. You are responsible for the accuracy of the information you provide to us and you are expected to update any information you provide us with.

General. We use your personal data to:

  • identify the user of our services and for the development of our professional contact.
  • the management of Newsletters, email notifications or commercial communications in general about the services and products and the news, offers or promotions offered by Us.
  • manage any user accounts and services that we provide, compliance with the conditions of provision of our services and other legal communications.
  • communicate your contact data to Spacewell Energy (Dexma)’s parent company, Spacewell International NV NV/SA, (with registered office at Sneeuwbeslaan 20 bus 3, 2610 Wilrijk, incorporated under Belgian law and registered with the Crossroad Bank of Enterprises under number BE 0846.845.929) and eventually to other companies within their business group, in order to send you commercial communications about the services they provide.

Use of data by other users. If you have access to personal data of other users or persons, you agree to treat and use those data in accordance with the provisions of these conditions and only for the explicit purposes of the Services, unless you have the user’s consent. You will not facilitate or publish any personal data related to any individual that has not been authorized by said person or this Policy. You will protect the confidentiality of any accessible personal data and will prevent access by any unauthorised third party. You will inform us of any problem related to the management of user data within 24 hours after it occurs. You will be responsible for any illicit use that you make of data of other users, including any use contrary to applicable data protection laws and / or that violates this Privacy Policy.

The legal basis of this treatment is our legitimate interest in contacting you and responding to your requests about our business, providing you with our services and considering the Partnership and work requests.

If you accept, with your express consent, we will also send you our news bulletins, notification emails or general business communications about the Services and products and any new features, offers or promotions we offer.

In certain circumstances, we may treat your data in accordance with this policy to comply with a legal or regulatory obligation to which we are subject.

We treat your personal data confidentially in accordance with the applicable legislation. Unless stated otherwise, your personal data will not be provided to third parties.

We may give access to personal data to our service providers under contracts for the provision of services in favour of the company. We require that all third parties respect the security of their personal data and treat them in accordance with the law. We do not allow our external service providers to use your personal data for their own purposes and we only allow them to process your personal data for specific purposes and in accordance with our instructions.

If you do not wish to receive commercial information about Spacewell Energy (Dexma) and other services (defined below), you can choose not to receive it by sending a notification to legal@dexma.com or by clicking on the link to cancel the subscription in our email communications.

  1. INTERNATIONAL TRANSFER

v is headquartered in Spain. We use technology services from third parties for the provision of Services, who can process your data in the course of providing us with their services, the main ones of which are indicated below. These entities may be in jurisdictions that generally do not provide adequate guarantees in relation to the processing of personal data. Likewise, our Partners could be outside the territory of the European Economic Area.   1. DATA RETENTION

We will only retain your account data for as long as it is necessary to fulfil the purposes for which we collected them, including (a) the performance of the contract with registered users and (b) for the purposes of satisfying any legal, accounting, or reporting requirements. To determine the appropriate retention period for personal data, we consider the amount, nature and sensitivity of the personal data, the potential risk of harm from unauthorised use or disclosure of your personal data, the purposes for which we process your data personal and if we can achieve those purposes through other means and the applicable legal requirements.

Once such personal data is no longer used for the aforementioned purposes, it will be blocked for a period of 6 years, for legal or administrative reasons, such as the defence of our responsibility and compliance with mandatory legal obligations, subject to the applicable law.

We may anonymise your personal data (so that they can no longer associate with you) for research or statistical purposes, in which case we may use and retain this information indefinitely without prior notice.

You also have the right to file a complaint with the competent authority, in this case, the Spanish Agency for Data Protection (Spanish Agency for Data Protection), Jorge Juan Street, 6, 28001 Madrid, Spain.

10. GENERAL

We reserve the right to modify the terms of this Privacy Policy and will notify you by clear notice of these changes by email, on our website, and in this Privacy Policy. If you continue to use our Services after such update, you will be deemed to accept the new terms. If you do not accept the update, let us know and we will cancel your account and we will delete your personal data (except when it is necessary to keep them for legal purposes) and you will not be able to continue using our services.

Unless a specific local regulation sets forth to the contrary, the Privacy Policy is governed by the laws of Spain.
